These Terms of Service govern your company's use of InspectWarden, the field inspection and recordkeeping service for fire and life-safety contractors.

01 / Access

The service and your account

InspectWarden provides tools to create, organize, search, and share fire and life-safety inspection records. We may change or improve features over time, but will not materially reduce the core service without reasonable notice.

You must provide accurate account information, keep login credentials secure, and ensure that each person uses their own account. You are responsible for activity under your workspace and for giving users only the permissions they need. You must be authorized to accept these terms for the company or organization that owns the workspace.

02 / Subscription

Subscription and billing

InspectWarden costs $49 per technician per month. Billing is based on the number of active technicians in the workspace, using this seat rule: the billable technician count is min(active technicians, 3). Office and administrator users are free, and technicians four and above are free for billing purposes. This means a workspace is billed for no more than three technician seats at a time.

Subscriptions renew monthly unless canceled. You authorize the payment method on file to be charged for the applicable subscription, taxes, and other amounts shown at checkout. Stripe processes payment details and payments for us. If a payment fails, we may limit access or suspend the workspace after giving reasonable notice.

You may cancel before the next renewal through the available account or billing controls. Cancellation takes effect at the end of the current paid period, and you can use the service until then. Subscription charges are non-refundable and we do not provide prorated refunds for a partial month, except where required by law or expressly agreed in writing.

03 / Use

Acceptable use

You may not use InspectWarden to:

  • break the law, violate a person's rights, or create a safety risk;
  • upload malware or interfere with the service or its security;
  • access another workspace or account without authorization;
  • scrape, reverse engineer, resell, or copy the service except as allowed by law; or
  • store content that you do not have the right to collect, use, or share.

We may investigate violations and suspend or terminate access that threatens the service, users, or other customers. When practical, we will give notice and an opportunity to resolve the issue.

04 / Your records

Customer data and inspection records

You retain ownership of the company information, customer information, inspection records, notes, and photos that you submit to InspectWarden (“Customer Data”). You give us the limited rights needed to host, process, display, back up, secure, and transmit Customer Data to provide and improve the service at your direction.

You are responsible for Customer Data, including its accuracy, lawful collection, permissions, and the people to whom you share records. You should maintain any copies you need for your own legal, operational, or regulatory requirements.

We may remove Customer Data when these terms end, subject to our Privacy Notice, legal obligations, and routine backup cycles. If you need an export, request it before closing the workspace.

05 / Professional judgment

Inspection-record disclaimer

InspectWarden is a recordkeeping tool, not a fire-protection authority, engineer, inspector, attorney, or compliance adviser. The service does not determine whether an inspection is code-compliant, complete, safe, or accepted by an authority having jurisdiction. Requirements vary by location, property, equipment, and authority.

You and your qualified personnel are responsible for professional judgment, the work performed, the information entered, the accuracy of each record, and checking applicable laws, codes, standards, contracts, and customer requirements. We do not warrant that an inspection record will satisfy any particular authority, insurer, customer, or legal requirement.

06 / Risk

Disclaimers and limitation of liability

To the maximum extent permitted by law, InspectWarden is provided “as is” and “as available.” We disclaim warranties of merchantability, fitness for a particular purpose, title, non-infringement, uninterrupted availability, and error-free operation. We do not promise that the service or any inspection record will meet your requirements or prevent every loss, deficiency, or incident.

To the maximum extent permitted by law, InspectWarden and its providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, business, goodwill, or data. Our total liability arising out of or related to the service or these terms will not exceed the greater of the fees you paid to InspectWarden for the service in the twelve months before the event giving rise to the claim or $100.

These limits do not apply where the law does not allow them, including liability that cannot legally be limited or excluded. Nothing in these terms changes rights that consumers cannot waive under applicable law.

07 / Closing terms

Termination and governing law

You may stop using the service at any time. We may suspend or terminate access for a material breach, nonpayment, legal requirement, or risk to the service. Sections concerning payment, Customer Data, disclaimers, liability, and any provision that by its nature should continue will survive termination.

These terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in North Carolina, and the parties consent to that jurisdiction and venue, unless applicable law requires another forum.

We may update these terms from time to time. For material changes, we will provide reasonable notice. Continued use after the effective date of an update means you accept the revised terms. If a provision is unenforceable, the remaining provisions remain in effect. These terms and the Privacy Notice are the complete agreement for the service and replace earlier terms about it.
